INFORMATION ON THE CENTRAL WASATCH COMMISSION’S ENVIRONMENTAL DASHBOARD IS MADE AVAILABLE AS A PUBLIC SERVICE, WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, AND IS SUBJECT TO THE FOLLOWING DISCLAIMERS:

1. ACCURACY, CHANGES, AND CONTINUITY OF SERVICE

The Central Wasatch Commission (CWC) tries to ensure that the information made available on the CWC Web sites is accurate and complete. Due to factors beyond the control of the CWC, however, it cannot guarantee against unauthorized modifications of information or errors made in inputting and posting data. The CWC may make changes to a Web page at any time to update, add, or correct the information made available. The CWC may suspend or discontinue making the information available.

1. NO WARRANTIES

The CWC disclaims any express or implied warranties related to making its computer system available for public use, and for any materials, information, graphics, products, or processes contained within its computer system. It makes no warranty, express or implied, nor assumes any responsibility for the use of information on the CWC’s Web sites or computer system/s, or for the computer system’s fitness for any general or particular purpose. Nor does the CWC warrant that the use of information on the CWC’s system will not infringe or violate the rights of others. The public is granted access to information on the CWC’s computer system on a strictly “as is” basis. The CWC denies responsibility for the conduct of its users.

1. SUBMISSIONS

Certain CWC websites invite users to submit content to CWC that CWC may include on CWC websites. In these circumstances, the CWC invites users to submit content solely for the purpose of identifying content that CWC can use to communicate CWC’s messages. The CWC Web sites are not a public forum and users should not expect that content submitted will be posted on the CWC websites. If the CWC chooses to post any content, it does so solely at its own discretion and for the purpose of communicating the messages of the CWC. The CWC exercises final approval authority over any content it chooses to post to the CWC Websites and may remove submitted content at any time at its discretion.

While the CWC may choose to post submitted content for the purpose of communicating the CWC’s messages, the CWC disclaims any responsibility for any information, materials, opinions, endorsements of products or services, or any other content located or made available on external sites.

1. EXTERNAL LINKS; PERSONAL OPINIONS

The CWC may choose to provide hypertext or other links to non-CWC websites. As with circumstances where the CWC chooses to post content submitted by users, the CWC posts these links for the purpose of communicating the CWC’s messages. If the CWC chooses to provide a link to any non-CWC website, it does so solely at its own discretion. The CWC Website is not a public forum and users submitting links to the CWC should not expect that any link submitted will be posted on Utah.gov websites. Utah.gov exercises final approval authority over any links to non-Utah.gov websites it chooses to post and may remove links at any time at its discretion. While Utah.gov may provide a link to these sites for its own purpose of communicating the CWC messages, the CWC disclaims legal responsibility for any information, materials, opinions, endorsements of products or services, or any other content located or made available on external sites.No other sections of this disclaimer statement are applicable to external sites beyond the control of the State.

1. COPYRIGHT LIMITATIONS

the CWC has made the content of certain pages of its Web sites available to the public. Anyone may view, copy, or distribute information found within these web pages (not including the design or layout of the pages) for personal or informational use without owing an obligation to the CWC if the documents are not modified in any respect, and unless otherwise stated on the particular materials or information to which a restriction on free use applies. The CWC makes no warranty, however, that the materials contained within these pages are free from copyright claims, or other restrictions or limitations on free use or display. The CWC disclaims any liability for the improper or incorrect use of information obtained from its Web sites.

1. ASSUMPTION OF RISK OF USE

One who uses the information available for public use on the CWC’s computer system assumes the risk of using or relying on such information. Neither the CWC, its employees, nor its agents shall be liable for any damages, including indirect, special, incidental, or consequential damages a user incurs as a result of viewing, distributing, or copying materials on the sites made available to the public, even if advised of the possibility of such damages.

1. MONITORING AND PROTECTING THE SYSTEM FROM INTRUSION

All CWC computer systems are subject to monitoring to assure proper functioning of the system and to provide security for the computer system’s operation. By using the computer systems you are consenting to the exercise of such monitoring practices. The CWC reserves the right to use any legally appropriate measures to prevent and investigate anyone attempting to modify, deface, delete, or otherwise tamper with or abuse a CWC Web site, server, database, information system, or other CWC technology asset.

1. UTAH LAW AND JURISDICTION

The materials made available for public use on the CWC ‘s Web sites are for the use and benefit of the general public. Any person who uses these systems or attempts to gain access to information or materials on these systems is subject to the jurisdiction of the State of Utah. Any dispute arising from a person using or attempting to use information or materials on the CWC’s Web sites shall be determined in accordance with Utah laws and in the courts of Utah.

Privacy Policy

Purpose

The Central Wasatch Commission (CWC) is committed to protecting the privacy of those accessing its Web sites. The purpose of this policy is to inform those accessing the CWC Web site about the collection and use of the personally identifiable information of its users.

Scope

This privacy policy statement applies to the Central Wasatch Commission

Definition of Personally Identifiable Information

For the purposes of this policy “personally identifiable information” means any information collected online that could serve to identify an individual, such as:

• First and last name
• Physical address
• Email address
• Telephone number
• Social Security number
• Credit card information
• Account Number
• Bank account information
• Any combination of personal information that could be used to determine identity

Collection of Information

The following information may be automatically collected and retained if you look or search through our web pages, or download information:

• The Internet domain and Internet Protocol (IP) address of the computer you are using to access our site;
• The type of browser and operating system used to visit our site;
• The date and time of when you access our site; and
• Which portions of the website you visit

The data collected serve as part of our statistical analysis about the use of our Web sites so we may better design online services and improve access to them. We do not attempt to gain personally identifiable information about individual users and associate it with IP addresses unless explicitly stated as part of a government agency service. The CWC does not use the information automatically collected to ascertain your personally identifiable information. The CWC may detect user IP addresses for providing location based user information and services. The CWC does not maintain or collect user IP addresses, or disclose such addresses to any third parties.

Except where specified, you do not have to provide personally identifiable information to visit or download information from the CWC websites. Unless you choose to make your personally identifiable information available to us, the CWC does not collect such information from you. The CWC does not use or place spyware on your computer. Be aware that government agencies may request personally identifiable information from you in order to perform requested specialized services.

How Personally Identifiable Information Is Used by the Governmental Entity

Email or other information requests sent to the CWC website may be saved and used to respond to the request, forward the request to the appropriate contact, communicate updates to the CWC site that may be of interest to citizens, or provide the CWC web designer with valuable customer feedback to assist in improving the Web site.

Any personally identifiable information an individual provides to the CWC site will be used solely by the CWC, its entities, and third party agents with whom it has contracted to perform a state function on its behalf, unless the information is designated as public record by an individual State agency as authorized under the “Government Records Access and Management Act” (GRAMA), and the State agency’s Web site provides conspicuous notice that such information is subject to public access.

Collection and Use of Information – Children’s Personally Identifiable Information

Except as otherwise permitted by law, the CWC does not knowingly collect and use or disclose the personally identifiable information of a child under the age of 13.

Personally Identifiable Information Available or Collected from Governmental Web Sites

Information collected is subject to the access provisions of GRAMA and other applicable sections of the Utah Code, federal regulations, and federal law. Consequently, certain communications may be subject to public disclosure. However, in these instances you will be notified by the CWC.

All records that are prepared, owned, received, or retained by a governmental entity that may be reproduced by certain means are considered public, unless they are private, controlled or protected as outlined in GRAMA, or are records to which access is restricted according to court rule, other State law, federal law, or federal regulation. Information that is generally considered public record under GRAMA – and not made confidential elsewhere in the Utah Code or by federal law – may be subject to electronic access through the CWC site.

Personally Identifiable Information is used by the governmental entities for the purpose of conducting official state business. A governmental entity may share Personally Identifiable Information with another governmental entity if it is designated as a record that is private, controlled, or protected as described in Section 63-2-206 unless such data sharing is expressly prohibited, authorized or required by federal law, state law, or federal regulation. In some instances a Governor’s directive or executive order may limit or prohibit data sharing even though Section 63-2-206 may permit such data sharing.

Data Security and Quality

The CWC is committed to data security and the data integrity of Personally Identifiable Information available from or collected by the CWC Web site. The CWC has taken precautions to protect personally identifiable information from loss, misuse, or alteration. Any authorized third parties responsible for this information are committed to the same principles, and are required by contract to follow the same policies and guidelines as the CWC in protecting this information. Visitors should be aware, however, that even though protections are in place, the CWC cannot guarantee against the occurrence of hardware failure, unauthorized intrusion, or other technical problems.

Procedures for Access by the User To View Or Correct Personally Identifiable Information

Unless otherwise prohibited by State law, federal law, or federal regulation, an individual may access and correct Personally Identifiable Information whether or not the inaccuracy was created by accident, unauthorized access, or a change in circumstances. The CWC also reserves the right to use any legally appropriate measures to prevent, monitor, and investigate any attempt to deface, delete, or otherwise tamper with or abuse the CWC site, server, database, information system, or other CWC technology asset.

Non-CWC Web Sites

Visitors may link to various Web sites from the CWC Web pages. The CWC is not responsible for the privacy practices or content of external sites. Many of these sites, particularly those in the private sector, may not be subject to GRAMA, other sections of the Utah Code, or federal law. Those visiting external sites are advised to check the applicable privacy statement and be cautious about providing personally identifiable information without a clear understanding of how the information will be used.

Changes to and Versions of the Privacy Policy

This privacy policy may be changed at any time; any changes will be posted on this web page. The version number and date the policy was last revised will be noted on the policy.
